1. Acceptance of terms

By accessing or using AudGrade ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms from time to time; continued use after changes are posted constitutes acceptance of the revised terms.

2. Eligibility and accounts

You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your sign-in email and for all activity that occurs through your account. Notify us promptly if you believe your account has been accessed without authorization.

3. Use of the Service

You agree not to:

  • Scrape, copy, or republish substantial portions of the Service without written permission;
  • Submit false, defamatory, harassing, or unlawful content;
  • Impersonate any person or misrepresent your affiliation with any employer;
  • Attempt to interfere with the integrity or performance of the Service;
  • Use automated means to access the Service except as expressly permitted.

4. User-submitted content

Reviews, salaries, and other content you submit must be your own first-hand experience and truthful to the best of your knowledge. By submitting content, you grant AudGrade a worldwide, royalty-free, perpetual license to display, distribute, and use that content in connection with operating and promoting the Service. We moderate submissions and reserve the right to refuse or remove content that violates these terms.

5. No warranty on data accuracy

The Service aggregates data from public sources (including U.S. Bureau of Labor Statistics OEWS estimates and public job postings) and from user submissions. Salary baselines, hiring practices grades, employer profiles, and reviews are provided "as is" without warranty of any kind, express or implied, including warranties of accuracy, completeness, fitness for a particular purpose, or non-infringement. Do not rely on the Service as the sole basis for any employment, hiring, or compensation decision.

6. Employer and recruiter terms

Employers, recruiters, and agencies who claim profiles, post jobs, or purchase promoted placements are subject to additional terms specific to those products. Those terms will be presented at the point of purchase or claim. (Placeholder — detailed employer/recruiter terms will be published with the launch of those features.)

7. DMCA and copyright complaints

We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a written notice to our designated agent including: (a) identification of the copyrighted work claimed to be infringed; (b) the URL or location of the allegedly infringing material; (c) your contact information; (d) a statement that you have a good-faith belief that the use is not authorized; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on the owner's behalf; (f) your physical or electronic signature.

8. Disclaimer and limitation of liability

To the maximum extent permitted by law, AudGrade disclaims all warranties and shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

9. Indemnification

You agree to indemnify and hold AudGrade, its officers, and contributors harmless from any claim or demand arising from your use of the Service or your violation of these terms.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Sections that by their nature should survive termination (including content license, disclaimers, and limitations of liability) will survive.

11. Governing law

These terms are governed by the laws of the United States and the State in which AudGrade is incorporated, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the state and federal courts located there for any dispute arising out of these terms or the Service.
